KIWANDA ROASTERY TOUR - OVERVIEW

 

This Overview must be read in conjunction with the “Kiwanda Roastery Tour – Waiver”, which will be presented upon arrival. 

1. Tours

1.1 We offer to select and approved persons, the opportunity to undertake a guided tour of our roasting facilities, sensory room and cupping room to experience firsthand how coffee beans are roasted (Tour).

1.2 Any offer by us for a Tour of the Facility is at our absolute discretion and we reserve the right to:

(a) cancel and/or change any Tour of the Facility that may be organised; and

(b) prohibit any person from participating or taking part in any Tour for any reason at our sole discretion.

 

2. Terms

2.1 The terms:

(a) we/us/our refers to Kiwanda Cafe Pty Ltd ACN 627 726 078;

(b) you or your refers to the individual signing this form; and

(c) Facility means 124 Distillery Road, Eagleby, Qld 4207.

2.2 This form is entered into as a deed poll by you in favour of us and thereby creates a binding contractual arrangement between us and you.

 

3. What to expect

3.1 The Tour consists of:

(a) a safety briefing;

(b) documentary/overview of the Zarraffa’s Coffee® business;

(c) guided tour into the roasting area of the Facility;

(d) a sensory experience with virtual reality head-sets; and

(e) coffee cupping and sampling session.

3.2 The Tour is expected to take 1.5 hours. The Tour occurs in a working environment and you should at all times remain vigilant of the activity occurring in the areas you are guided to.

3.3 The roasting of coffee requires the use of industrial machinery, which is hot and will cause injury if touched and exposure to a high level of noise. You acknowledge that if you do not follow our directions, you may cause injury to yourself.

 

4. What is this form about

4.1 We are offering you the Tour, but it comes with inherent risks and dangers, including personal injury, that you must consider prior to undertaking the Tour and voluntarily assume, if you undertake the Tour.

4.2 The risks and dangers you may be exposed to when undertaking the Tour, include:

(a) exposure to heat;

(b) burning if you touch any of the equipment;

(c) excessive noise, that exceeds the decibel equivalent of 20 μPa and may cause harm to hearing;

(d) industrial machinery in the form of forklifts and stock pickers, which may injure you if you come into contact;

(e) disorientation from undertaking the virtual reality sensory activity;

(f) effects usually associated with the consumption of caffeine where you undertake the cupping session.

The above is not an exhaustive list and the risks and dangers may change depending on the working conditions at the time of your Tour.

4.3 By signing this form:

(a) you are accepting of those risks and dangers and agree to follow our reasonable directions, including signage placed around the Facility, in order to mitigate those dangers to you;

(b) acknowledge that we have disclosed these risks and dangers to you; and

(c) expressly disclose:

(i) that you are agreeing to waive certain rights that you may have against us, including the ability to sue or make a claim against us for any injury you may incur whilst undertaking the Tour. Your rights by signing this form are restricted, modified or excluded;

(ii) where you sign for a minor, you are providing an indemnity to us for any injury incurred by the minor whilst undertaking the Tour – this means that even if the minor is successful in any action against us, we may recover such amount awarded from you; and

(iii) to the extent it may apply, you are agreeing to exclude, restrict and modify the effect of the statutory guarantees provided under the Australian Consumer Law, expect to the extent of any gross negligence on our part. This does not apply to minors.

4.4 It is your choice to enter into this form, however, where you decide not to, we are not obliged to provide the Tour to you.

4.5 You are responsible for any damage caused to our property and you agree to indemnify us for any damage caused by you or any minor that you are responsible for.

 

5. Minors

Participants must be at least 12 years of age or older to undertake the Tour. An adult guardian or parent must remain with any minors (under 18 years of age) at all times while on the Tour.

6. Sickness or allergies

Before commencing a Tour, you must fully and completely disclose to us any sickness, illness and/or allergy you may have. In this circumstance, we may decide that you cannot attend the Tour or we may ask you to wear a face mask during the Tour.

 

Wheelchair Access

The Facility has not been designed to be wheelchair accessible.

 

Safety on your Tour

8.1 Your participation in the Tour is conditional on you undertaking our safety briefing. In the safety briefing, we will address all of the requirements you must follow prior to being given access to any area in our Facility. This will include, amongst other things:

(a) standard of dress. To clarify, at all times while on the Tour, you must wear closed-in shoes that fully cover the foot (no heels, sandals or flip-flops are permitted).

(b) whether any personal protective equipment is required to be worn, such as protective eyewear and headphones to reduce noise levels;

(c) not carrying anything in your pockets or on your person;

(d) that you must follow any and all reasonable directions given by us;

(e) you must follow and only stand on designated walk ways;

(f) the general safety of yourself, those on the Tour with you and the employees and contractors working at the Facility.

8.2 Where you do not follow the directions given in your safety briefing, we reserve the right to immediately remove you from the area and/or Facility.

8.3 Smoking is only permitted in those parts of the Facility that are designated as smoking areas / zones. Smoking outside these areas are not permitted.

8.4 No alcohol, food or beverages (other than as offered or provided by us) is allowed to be consumed during the Tour.

8.5 We may require you to leave your belongings in your car or such other form of transport used by you to get to the Facility. We are not be responsible for any loss or damage of personal items left unaccompanied during any Tour of the Facility (including but not limited to where such items are left in any part of the Facility).

8.6 Lines or designated walkways may be in use during the Tour, which if designated, must be strictly followed at all times. In some instances, vehicles, forklifts and other machinery carrying heavy objects may be moving around areas involved in the Tour. Where applicable, the forklift will make a sound when in reverse, however, you should maintain a vigilant eye for the forklift and maintain caution when moving around during the Tour for any forklift, vehicles and/or other individuals.

9. Price

9.1 Any payments you have made in respect of the Tour are non-refundable. Prices quoted (if any) are in Australian dollars (AUD) and exclude GST. If you are unable to attend any booked Tour for any reason, we may, in our absolute discretion, elect to provide you a refund, however, we are under no obligation to do so.

9.2 We reserve the right to change the price of the Tour at any time without notice.
